The following prices are illustrative only. The actual cost of drafting, filing and prosecuting a patent application will vary greatly from case to case depending on the invention, the complexity of the application and the unpredictability of the Examiner's actions during prosecution. A written cost estimate for your application will be provided, upon request, following a consultation with us.

Patent Searches
  • Preliminary Online Search - FREE.
  • Patentability Search and Opinion - from $1000 to $2,000 (plus HST) depending on the type of technology, how many other patents are within the same field, and the depth and scope of the search.

Drafting and Filing a Patent Application
  • Provisional patent application (Canada) $1999+HST
  • USA Provisional patent application (through a US associate) $2199+HST
  • Simple Invention - from $3,950 to $5,950+HST. 
  • More Complex Invention - from $4,950 to $7,650+HST.
  • Very Complex Invention - from $6,500 to $11,200 +HST.

    NOTE: Costs will vary depending on the complexity of the invention, the field of technology and the quality of the "homework" performed by the inventor (such as: identification of most relevant prior art, pre-drafting of written disclosure, provision of acceptable drawings, etc.). 



Prosecution Stage
Our fees range from $1,000 to $7,000. The cost varies greatly from case to case depending on the circumstances under which the patent application was filed, the number of office actions and the nature of objections raised. As such, we cannot provide a precise estimate of the costs of patent prosecution, and can only provide an expected range.

Government Fees
In addition to the above professional fees, there are several government fees due upon the filing of the application and at various points during the prosecution. These fees include the filing, examination, maintenance, assignment and issue/publication fees. The following is a sampling of these fees for Canada:
  • Canada (small entity): Filing fee $200, examination fee $400, extension of time fee $200, issuance fee $150, annual maintenance fees $50-$225 (increasing gradually every 5 years).
  • Canada (large entity): Filing fee $400, examination fee $800, extension of time fee $200, issuance fee $300, annual maintenance fees $100-$450 (increasing gradually every 5 years).
